Version 3, 15.06.2009 1. “Zugangsrechte” Lizenzen und Nutzerrechte für neue kenntnisse und berufliche Kenntnisse und Schutzrechte; 2. `affiliated undertaking` means any legal person under the direct or indirect control of a beneficiary or under the same direct or indirect control as the beneficiary and which exercises one of the following forms: (a) the direct or indirect holding of more than 50 % of the nominal value of the issued share capital in the legal person concerned; either by a majority of the voting rights of the shareholders or members of that undertaking; (b) the direct or indirect, real or legal possession of decision-making powers within the legal person concerned. 3. `associated country` means a third country which is a party to an international agreement with the Community under the conditions or on the basis of which it makes a financial contribution to all or part of the Seventh Framework Programme; 4. `background` means information held by beneficiaries prior to their accession to this Agreement, as well as copyright or other intellectual property rights relating to such information, the application for which was submitted prior to their accession to this Agreement and which is necessary for the implementation of the project or the use of new knowledge and property rights; (5) `dissemination` means the disclosure of foreground by appropriate means other than those resulting from the formalities for its protection, including the publication of foreground in any medium; (6) `fair and reasonable conditions` means appropriate conditions, including all financial conditions, taking into account the specific circumstances of the access request, e.B. the actual or potential value of the foreground or foreground to which access is requested and/or the extent, duration or other characteristics of the intended use; (7) `foreground` means the results, including information, whether protectable or not, generated in the context of the project.

These results include copyright rights; design rights; patent rights; plant variety protection; or similar forms of protection; (8) `use` means the direct or indirect use of new knowledge and intellectual property rights for other research activities not covered by the project or for the development, creation and marketing of a product or process or for the creation and provision of a service; (9) `third country` means a State which is not a Member State; 10. `irregularity` means any infringement of a provision of Community law or any failure resulting from an act or omission of a beneficiary which has or would have the effect of causing damage to the general budget of the European Communities or to the budgets managed by them by unjustified expenditure; (11) `public body` means any legal person constituted as such under national law and international organisations; 12. A legal person is classified as a “non-profit organization” if it is considered as such under national or international law; (13) `research organisation` means a legal person established as a non-profit organisation which makes research or technological development one of its main objectives; FP7 Grant Agreement – Annex II “General Conditions” Version 3. .
