The examiner must first complete and submit a form required to initiate a material transfer agreement. UNHInnovation employees use the information to prepare and negotiate the MTA with the proposed recipient organization and to coordinate with any necessary UNH departments or committees, including, where applicable, the Bureau of Environmental Health and Safety (OEHS), to ensure that the material to be shipped complies with all applicable federal and state regulations. Once UNHInnovation has received a fully signed MTA, UNHInnovation notifies the UNH investigator who can pack and ship the material. An MTA is a binding written contract between the parties that governs the use of the exchanged material. ATMs generally reflect the fact that one of the parties has a ownership interest in the material exchanged and that the other party intends to use the material for its own research purposes. Examples of materials may include: test materials, monoclonal antibodies, cell lines, mouse strains, plant varieties, technical data, software, confidential information, integrated circuit designs, plans, products, processes, devices, manufactured devices or any single material. Material resulting from academic activities (p.B a study programme or lecture notes) and material purchased would not normally fall within the parameters of an MTA. Intra-UNH transfers of equipment are not subject to ATMs. UNH and several hundred other academic institutions and private organizations have adopted and signed a UBMTA Master funded by the National Institutes of Health (NIH) and the Association of University Technology Managers (AUTM). If an MTA is required for the exchange of documents and both the receiving and contributing entities are participants in the UBMTA, a letter of implementation from the UBMTA must be used. To facilitate the transfer of materials, UNH has established MTA guidelines.

In general, UNH agrees to make available to other organizations documents in which it has a proprietary right when performing an ATM in order to ensure the conditional use of the material by the receiving party. UNH will also facilitate the transfer of materiel from external organizations to UNH by taking over the institutional review, negotiation and coordination of all NMAs of external organizations. UnH faculty, staff and students are responsible for complying with the conditions of the MTA and for the safe use of the equipment. Unless a third party has a right of ownership, transfers of material within the UNH are not subject to ATM. Notwithstanding the foregoing, the Senior Vice-President, Research (SVPR) reserves all rights, powers and responsibilities to protect the interests of UNH as set forth in the UNH Intellectual Property Policy, other applicable policies and as agreed with other UNH offices and committees. Therefore, the SVPR reserves the right to refuse any request to sign an MTA. Material Transfer Agreements (MTAs) deal with the exchange of research material between individuals in separate organizations and address, among other things, ownership, intellectual property, publications and liability related to research papers. At UNH, we try to use the UBMTA (see below for further explanations) where possible to streamline the implementation of these agreements. NMAs from external organizations are reviewed, negotiated and signed by UNHInnovation on behalf of the Senior Vice-President, Research.

These reviews may include consultations with other UNH departments or committees such as the Bureau of Environmental Health and Safety (OEHS), the Sponsored Programs Administration (SPA) and the UNH Institutional Committee for Animal Care and Use (IACUC). After negotiation, the MTA is signed by UNHInnovation and the specified recipient. The material that a H receives as part of an MTA can be inventoried by OEHS or other appropriate bodies if necessary. UNH investigators may be regularly questioned about the disposal of this material. Faculties sponsoring visiting researchers must disclose all documents to be used on UNH premises. Contact the Environmental Health and Safety Board for information on how to process incoming and outgoing materials. In the case of outgoing documents, the examiner must first complete the form “Information required to initiate a material transfer agreement” and submit it to UNHInnovation. UNHInnovation will then prepare the UMBTA execution letter, which contains by reference the standard conditions of the UBMTA. MTAs offer UNH teachers, staff and students many advantages: biological material (antibodies, cell lines, etc.) can have considerable commercial value. For this reason, it is often hesitated today to make this material available free of charge to third parties. MTAs have been developed so as not to paralyze exchange, which is important for academic progress.

MTAs allow for the exchange of (biological) material between academic institutions, but they regulate exactly what the recipient is allowed to do with the material and what the ownership structure looks like. Similarly, MTAs are also used by companies for the transfer of material to academic institutions, as the conditions for academic research are often restrictive.
